Voorwaarden docenten

Duur van de overeenkomst. De overeenkomst gaat in vanaf het moment dat de docent een geactiveerd profiel heeft bij SoM. Beide partijen kunnen deze overeenkomst schriftelijk opzeggen met inachtneming van een opzegtermijn van twee maanden. Als er geen actieve inschrijving is kan de overeenkomst ten allen tijde per direct worden beëindigd.
Werkwijze. De docent heeft kennisgenomen van de werkwijze van SoM zoals aangegeven op help.schoolofmusic.nl. Aanpassingen in het lesrooster dienen waar mogelijk voor de 25e van de voorgaande maand ingevoerd te zijn via het docentenaccount op schoolofmusic.nl. Lessen op basis van prepaid tegoed kunnen hier ook door de docent worden toegevoegd.
Zelfstandigheid. De docent zal in opdracht en ten behoeve van SoM muzieklessen verzorgen. De docent is bij het uitvoeren van deze werkzaamheden geheel zelfstandig. De docent heeft de artistieke leiding en bepaalt de inhoud van het muziekonderwijs. Het staat de docent vrij om de werkzaamheden naar eigen inzicht te verrichten. De docent is jegens SoM wel aansprakelijk voor de inhoud en de uitvoering van de werkzaamheden.
Vervanger. De docent kan de afgesproken werkzaamheden deels of geheel door een vervanger laten verrichten. Wanneer de lessen op een door SoM beheerde locatie plaatsvinden dient dit vooraf met SoM te worden afgestemd. De vervanger dient bevoegd docent muziekonderwijs te zijn, of daarvoor in opleiding. De docent blijft te allen tijde jegens SoM aansprakelijk voor de inhoud en de uitvoering van de werkzaamheden.
Aansprakelijkheid. SoM is niet aansprakelijk voor door docent bij of ten gevolge van uitvoering van een opdracht geleden schade.
Vergoeding. De docent ontvangt voor privélessen een vergoeding op basis van het zelf gekozen lestarief. SoM rekent uitsluitend kosten in de vorm van een commissie over de gegeven lessen. Dit is 18,4% bij gebruikmaking van een eigen locatie, of lessen aan huis. Bij gebruik van een door SoM beheerde locatie is dit 31,4%.
Gemiste lessen door afwezigheid van de docent worden niet vergoed, tenzij deze ingehaald worden of gegeven worden door een vervanger. Gemaakte kosten zoals reiskosten en eigen lesmaterialen vallen voor rekening van de docent.
Proeflessen. Een proefles duurt in het geval van privéles 30 minuten, bij een groepsles is de duur gelijk aan de lesduur. De docent dient te zorgen voor een juiste beschikbaarheid en is na het boeken van de proefles de eerste contactpersoon voor de aanvrager.
Opzegtermijn. De accounthouder heeft in het geval van een doorlopend abonnement een opzegtermijn van 30 dagen. Individuele lessen die binnen deze termijn worden afgezegd worden ook aan de accounthouder in rekening gebracht. De opzegtermijn vervalt wanneer de accounthouder niet instemt met een wijziging door de docent van tijdstip, lesdag of locatie. De opzegtermijn is weer van kracht zodra de accounthouder schriftelijk heeft ingestemd met de wijziging.
In het geval van prepaid lessen geldt een afmeldtermijn van 24 uur voor ingeplande lessen.
SoM behoudt zich het recht om de opzegtermijn te verkorten of te annuleren wanneer daar aanleiding toe is. De docent mag tevens ten allen tijde zelf beslissen om de opzegtermijn te verkorten of te annuleren.
Exclusiviteit. Cursisten die zijn aangemeld via SoM, mogen uitsluitend worden ingeschreven via SoM. Dit betekent dat voor de inschrijving en de voorwaarden moet worden doorverwezen naar de website van SoM, tenzij anders overeengekomen. Cursisten die zich buiten SoM om hebben aangemeld zijn niet verplicht om bij SoM in te schrijven.
Minimumprijs. Het is de docent niet toegestaan om muzieklessen onder de prijs van School of Music aan te bieden in een vergelijkbare setting binnen een straal van 5 km rondom de leslocatie. Hiervan uitgesloten zijn lessen aan cursisten die reeds ingeschreven staan bij aanvang. Tevens geldt dit niet voor lessen bij muziekscholen met een vast tarief.Cursisten vanaf 21 jaar zijn bij ons altijd btw-plichtig. De docent is verplicht om minimaal dit tarief aan te houden, ook wanneer deze zonder btw factureert zoals in de KOR regeling.
Facturatie. De docent dient SoM na elke gewerkte maand een gespecificeerde factuur te sturen die overeenkomt met het facturatieoverzicht in het docentenaccount. De factuur bevat alle relevante gegevens van de docent, onder meer bankrekening met IBAN vermelding, het btw nummer en KvK nummer (indien van toepassing).
Belastingaangifte. De docent is zelf verantwoordelijk voor afdracht van belastingen en/of premies aan de belastingdienst.
Beëindigen overeenkomst bij zelfstandige leslocatie. Om de samenwerking te beëindigen met behoud van cursisten geldt een opzegtermijn van 12 maanden of een afkoopsom per cursist. Deze bedraagt excl. btw in het eerste jaar na inschrijving €200, in het tweede jaar na inschrijving €150 en na 2 jaar of langer ingeschreven €100. Onder deze regeling vallen alle leerlingen die vanaf het moment van samenwerking les zullen gaan volgen bij de docent via School of Music. Leerlingen die voor de start van de samenwerking al les volgden bij de docent vallen niet onder deze regeling.
Evaluatie. SoM behoudt zich het recht om docentenprofielen op de site te beperken of te verbergen wanneer hiertoe enige aanleiding is. Dit kan kan onder andere inhouden: het verbergen van het docentenprofiel wanneer de proeflesconversie te laag is; het verbergen van het contactformulier wanneer er te weinig boekingen uit voortkomen; het verbergen van de beschikbare tijden wanneer er meerdere proeflessen achtereen zijn geannuleerd. De score op bovengenoemde punten wordt aan de docent getoond in de login omgeving.

Duration of the agreement. The agreement starts from the moment the teacher has an activated profile with SoM. Both parties can terminate this agreement in writing subject to two months' notice. If there is no active registration, the agreement can be terminated at any time with immediate effect.
Working method. The teacher has taken note of the working method of SoM as indicated on help.schoolofmusic.nl. Adjustments in the class schedule should, where possible, be made before the 25th of the previous month through the teacher account on schoolofmusic.nl. Lessons based on prepaid credit can also be added by the teacher.
Independence. The teacher will provide music lessons on behalf of SoM. The teacher is completely independent in performing these activities. The teacher has the artistic direction and determines the content of the music education. The teacher is free to perform the activities as he or she sees fit. The teacher is liable towards SoM for the content and execution of the activities.
Replacement. The teacher may have some or all of the agreed work performed by a substitute. If the lessons take place at a location managed by SoM, this must be coordinated with SoM in advance. The substitute must be a qualified music education teacher, or a trainee in this field. The teacher remains liable to SoM at all times for the content and performance of the work.
Liability. SoM is not liable for damages suffered by a teacher during or as a result of the execution of an assignment.
Compensation. The teacher receives a fee for private lessons based on the self-selected lesson rate. SoM only charges fees in the form of a commission on the lessons given. This is 18.4% when using a private location, or lessons at student places. When using a SoM-managed venue, it is 31.4%.
Missed lessons due to absence of the teacher will not be reimbursed unless they are made up or taught by a substitute. Costs incurred such as travel expenses and own teaching materials are the responsibility of the teacher.
Trial lessons. In the case of private lessons, a trial lesson lasts 30 minutes; in the case of group lessons, the duration is equal to the lesson duration. The teacher must ensure proper availability and is the first contact for the applicant after booking the trial lesson.
Notice period. In the case of a recurring subscription, the account holder has a 30-day cancellation period. Individual lessons cancelled within this period will also be charged. The notice period expires if the account holder does not agree to a change by the teacher of time, lesson day or location. The notice period is effective again as soon as the account holder has agreed to the change in writing.In the case of prepaid lessons, a cancellation period of 24 hours applies to scheduled lessons.SoM reserves the right to shorten or cancel the notice period when there is reason to do so. The teacher may at any time decide to make exceptions for the course participant.
Exclusivity. Students who are registered through SoM may only be enrolled through SoM. This means that the registration and conditions must be referred to the SoM website, unless agreed otherwise. Course members who have registered outside SoM are not obliged to register with SoM.
Minimum price: The teacher is not allowed to offer music lessons under the School of Music price in a comparable setting within a 5 km radius of the lesson location. Excluded from this are lessons to students who are already enrolled at the start. This also does not apply to lessons at fixed-rate music schools.
Students aged 21 and over are always subject to VAT. The teacher is obliged to charge at least this rate, even when billing without VAT as in the KOR scheme.
Invoicing. The teacher must send SoM a specified invoice after each month worked in accordance with the invoice overview on schoolofmusic.nl. The invoice contains all relevant data of the teacher, including bank account with IBAN, VAT number and Chamber of Commerce number.
Tax return. The teacher is responsible for the payment of taxes and/or premiums to the tax authorities.
Termination of contract at an independent teaching location. To terminate the collaboration while retaining students, a notice period of 12 months or a buy-out fee per student applies. This amounts to €200 in the first year after enrolment, €150 in the second year after enrolment and €100 after 2 years or more of enrolment. This arrangement covers all students who will take lessons with the teacher via School of Music from the start of the collaboration. Students who already took lessons with the teacher before the start of the collaboration are not covered by this arrangement.
Evaluation. SoM reserves the right to limit or hide teacher profiles on the site if there is any reason to do so. This may include: hiding the contact form when too few bookings result from it; hiding the available times when several trial lessons have been cancelled consecutively; hiding the teacher profile when the trial lesson conversion rate is too low. The score on the above points is displayed to the teacher in the login environment.
